1. About these Terms

These Terms and Conditions of Service (“Terms”) apply when you access or use the Clear Weekly mobile application, website and related digital services (together, the “Service”).

Please read these Terms carefully.

Clear Weekly is operated by [LEGAL ENTITY NAME], based in Victoria, Australia (“Clear Weekly”, “we”, “us” or “our”).

2. About Clear Weekly

Clear Weekly is a news and current affairs publication.

Clear Weekly aims to make important news easier to read and understand, including for people living with dementia and other people who benefit from clearer communication.

Clear Weekly may summarise, explain and rewrite information obtained from multiple sources. We may also provide additional background information to help readers understand a story.

Unless expressly stated otherwise, Clear Weekly is an independent publication and is not affiliated with, endorsed by or acting on behalf of any government, political party, news organisation, company or other organisation mentioned in our reporting.

3. Clear Weekly is currently free

Clear Weekly is currently provided free of charge.

There is currently no subscription fee required to access the Service.

We may introduce paid subscriptions, features or other services in the future.

If we do, the price and relevant terms will be clearly provided before you agree to make a purchase or start a paid subscription.

You will not be charged simply because you previously used the free version of Clear Weekly.

Any future paid services will be subject to applicable Australian consumer laws.

4. News and editorial content

Clear Weekly publishes news, current affairs, background information and explanatory journalism.

Our aim is to simplify the way information is communicated without unnecessarily simplifying the underlying facts.

Clear Weekly may select, shorten, reorganise and explain information to make a story easier to understand.

The date displayed on a Clear Weekly article is generally the date that Clear Weekly published that version of the article. It may differ from the date on which an original source or news report was published.

5. Accessibility

Clear Weekly aims to make news more accessible, including for people living with dementia and other people who benefit from clearer communication.

Our articles may use techniques such as shorter sentences, clear headings, explanations of unfamiliar terms, deliberate repetition, additional background information and simpler sentence structures.

These techniques are intended to reduce barriers to understanding.

Accessible writing cannot guarantee that every reader will understand every story.

People living with dementia have different experiences, abilities and accessibility needs.

6. Accuracy, corrections and developing stories

Clear Weekly aims to publish information that is accurate, fair and clearly presented.

News can change quickly. New information may become available after publication, sources may disagree and errors can occur.

We may correct, clarify, update or remove material where appropriate.

If you believe Clear Weekly has published a factual error, you can contact us using the details at the end of these Terms.

We will consider reasonable correction requests and may correct, clarify, update or remove material where appropriate.

7. Allegations, opinions and analysis

Some news stories involve allegations, disputed facts, political claims, opinions or competing interpretations of events.

Clear Weekly aims to distinguish clearly between established facts, allegations, opinions and analysis.

Reporting an allegation does not mean that Clear Weekly has determined that the allegation is true.

Quoting, reporting or summarising the views of another person or organisation does not mean that Clear Weekly endorses those views.

8. Sources and third-party content

Clear Weekly may use information from journalists, news agencies, governments, public authorities, researchers, organisations, public records and other sources.

Where appropriate, Clear Weekly may identify or link to these sources.

A reference or link to another organisation does not mean that Clear Weekly endorses that organisation or everything it publishes.

Third-party websites and services are controlled by their respective operators.

Clear Weekly is not responsible for the availability, security, privacy practices or content of third-party websites or services outside our control.

9. Artificial intelligence and illustrative images

Clear Weekly may use digital tools, including artificial intelligence, in research, drafting, editing, accessibility, image creation and production.

Clear Weekly remains responsible for the material it publishes.

Artificial intelligence and other digital tools can make mistakes. Their use does not guarantee that content will be free from error.

Clear Weekly may use generated or illustrative images where an appropriate photograph is not available or where an illustration helps explain a story.

We aim to identify AI-generated or substantially altered images where there is a reasonable possibility that a reader could otherwise mistake the image for a photograph of the actual people, place or event being reported.

10. General information, professional advice and emergencies

Clear Weekly provides news and information for general informational and educational purposes.

Clear Weekly's content is not personalised professional advice.

In particular, Clear Weekly content should not be treated as a substitute for individual medical, legal, financial, psychological, emergency or other specialist advice.

Where your circumstances require professional advice, you should seek assistance from an appropriately qualified professional.

Clear Weekly should not be relied upon as an emergency warning or emergency information service.

During an emergency, readers should follow information and instructions provided by the relevant emergency services and government authorities.

11. Intellectual property

Unless otherwise stated, original text, design, branding, logos, graphics and other original material created for Clear Weekly are owned by or licensed to Clear Weekly and may be protected by intellectual property laws.

You may access Clear Weekly content for personal and non-commercial use.

You may share links to Clear Weekly articles.

You may quote or otherwise use portions of Clear Weekly content where permitted by law, including applicable copyright exceptions.

You must not, without our permission or another lawful basis, reproduce or republish substantial parts of Clear Weekly content, present our content as your own, remove copyright or attribution information, commercially exploit our content in a way that infringes our rights, or use Clear Weekly's name or branding in a way that falsely suggests an affiliation or endorsement.

Nothing in these Terms limits rights you may have under Australian copyright law.

12. Acceptable use

You must not deliberately misuse the Service.

You must not use the Service to break the law, interfere with the operation or security of the Service, introduce malicious software, attempt to gain unauthorised access to systems or data, impersonate Clear Weekly or another person, or unlawfully reproduce or systematically extract substantial amounts of Clear Weekly content.

We may take reasonable steps to protect the Service against misuse or unlawful activity.

13. Availability and third-party technology

We aim to keep Clear Weekly available and functioning reliably, but we cannot guarantee that the Service will always be available, uninterrupted or free from technical errors.

Clear Weekly may rely on third-party technology and distribution providers, including GoodBarber, mobile app stores and other service providers.

Those providers may have their own terms and privacy practices.

We may reasonably change, add or remove features or content as Clear Weekly develops.

14. Privacy

Clear Weekly respects the privacy of its users.

Our separate Privacy Policy explains what personal information may be collected through Clear Weekly, how that information is used and disclosed, how it is protected, and the choices and rights available to users.

Third-party technology providers used to operate the Service may also process information as described in our Privacy Policy.

You should read the Privacy Policy together with these Terms.

15. Advertising and commercial relationships

Clear Weekly may introduce advertising, sponsorships, partnerships, affiliate relationships or other commercial arrangements in the future.

Where content is paid for or sponsored, we will aim to identify the commercial relationship clearly.

Advertisers and sponsors do not have the right to determine Clear Weekly's independent editorial reporting merely because they have a commercial relationship with Clear Weekly.

Advertising or sponsored content may be subject to separate terms where appropriate.

16. Liability and Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any right, guarantee, remedy or liability that cannot lawfully be excluded, restricted or modified, including rights under the Australian Consumer Law.

To the extent permitted by law, Clear Weekly does not guarantee that the Service will always be available or that every item of information will be complete, current or free from error.

You remain responsible for decisions you make based on general information published through the Service.

Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, restricted or modified, including rights under the Australian Consumer Law.

17. Changes to these Terms

We may update these Terms when Clear Weekly's services, business practices or applicable laws change.

The current version will be made available through the Service and will show the date on which it was last updated.

If a change materially affects users' rights or obligations, we will take reasonable steps to bring the change to users' attention.

A change to these Terms will not retrospectively create a payment obligation for a service that was free when you used it.

18. Governing law and contact details

These Terms are governed by the laws of Victoria, Australia.

Nothing in this section limits any rights you may have under applicable Australian consumer law.

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to operate to the extent permitted by law.
