1. About this Privacy Policy

Clear Weekly respects your privacy.

This Privacy Policy explains how personal information and other information may be collected, used, stored and disclosed when you use the Clear Weekly mobile application, website and related digital services (together, the “Service”).

Clear Weekly is operated by Sarah Newbold, based in Victoria, Australia (“Clear Weekly”, “we”, “us” or “our”).

This Privacy Policy should be read together with the Clear Weekly Terms and Conditions of Service.

We aim to manage personal information transparently and responsibly and, where applicable, in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

2. Our approach to privacy

Clear Weekly is a news and current affairs publication.

You do not generally need to tell us who you are simply to read Clear Weekly.

Where reasonably practicable, you may access general Clear Weekly news content without identifying yourself.

We aim to collect only information reasonably necessary to operate, secure, understand and improve the Service or provide features you choose to use.

3. Information we may collect

The information collected depends on how you use Clear Weekly and which features are enabled.

Information you provide

If you contact Clear Weekly, submit feedback, request a correction or otherwise communicate with us, we may collect:

your name;
your email address or other contact details;
the contents of your communication; and
any other information you choose to provide.

Please do not provide sensitive personal information unless it is reasonably necessary for your enquiry.

Technical and device information

When you use Clear Weekly, we or our technology providers may receive information such as:

your Internet Protocol (IP) address;
device type;
operating system;
browser type or identifier;
app version;
device or session identifiers;
language and general device settings;
dates and times of access;
diagnostic information; and
crash, security and performance information.

Usage information

We or our technology providers may collect information about how Clear Weekly is used, such as:

articles or pages viewed;
features used;
interactions with the Service;
approximate duration or frequency of use;
referring pages or sources; and
general analytics information.

We may use this information to operate, secure and improve Clear Weekly and understand how readers use the Service.

4. Health and other sensitive information

Clear Weekly does not require readers to provide health information or other sensitive personal information simply to read general news content.

Because Clear Weekly includes content designed to be accessible to people living with dementia, we do not assume or infer that a person has dementia, cognitive impairment or any other health condition merely because they use Clear Weekly or read particular content.

People may use Clear Weekly for many different reasons.

We do not intentionally profile readers according to an assumed health condition based solely on their use of dementia-friendly or accessible content.

If you voluntarily provide sensitive information when communicating with us, we will handle that information only as reasonably necessary for the purpose for which you provided it or as otherwise permitted or required by law.

5. How information is collected and used

Information may be collected directly from you, automatically through your use of the Service, or through technology providers that help us operate Clear Weekly.

We may use information to:

provide and operate Clear Weekly;
deliver articles and other content;
maintain the security and reliability of the Service;
diagnose and resolve technical problems;
understand how the Service is used;
improve accessibility, functionality and design;
respond to enquiries, feedback and correction requests;
communicate with you when you ask us to;
prevent misuse, fraud or security incidents;
comply with legal obligations; and
establish, exercise or defend legal rights.

We will not intentionally use personal information for an unrelated purpose where doing so would be inconsistent with applicable privacy law.

6. Analytics, cookies and similar technologies

Clear Weekly and its technology providers may use analytics tools, cookies, software development kits, log files or similar technologies to operate the Service and understand how it is used.

These technologies may collect technical and usage information.

Some technologies may store or access information on your device.

Where consent is required by applicable law for a particular technology or use, we will seek that consent.

You may be able to restrict certain cookies or permissions through your browser or device settings. Doing so may affect some functionality.

7. Push notifications and device permissions

If Clear Weekly offers push notifications, you can choose whether to receive them.

If you enable push notifications, technical identifiers associated with your device may be processed by technology providers so that notifications can be delivered.

You can normally disable notifications at any time through your device settings.

Clear Weekly does not need your precise location simply for you to read general news content.

If a feature requires access to your location or another device permission, we will request the relevant permission where required and explain its purpose where appropriate.

You can generally manage device permissions through your device settings.

8. Accounts, subscriptions and communications

Clear Weekly is currently free.

You do not need to pay a subscription fee simply to access the current free Service.

If Clear Weekly introduces or enables accounts, newsletters, memberships, subscriptions or other optional services, additional information may be required to provide those services.

Where this materially changes how personal information is collected or handled, we will update this Privacy Policy and provide any additional notice or consent required by law.

If user accounts are provided, Clear Weekly will provide account and associated-data deletion arrangements required by applicable law and applicable app-store requirements.

9. Service providers and GoodBarber

Clear Weekly relies on third-party service providers to operate and distribute the Service.

These providers may provide services such as app infrastructure and hosting, analytics, security, crash reporting, technical support, communications, push notifications, cloud infrastructure and app-store distribution.

Clear Weekly uses GoodBarber to provide app infrastructure and functionality.

GoodBarber may process technical, device and usage information on our behalf where necessary to operate the Service. The information processed depends on the features enabled in Clear Weekly.

GoodBarber maintains its own privacy and security information.

Other technology providers, including app-store operators, may independently collect information under their own privacy policies and terms.

We do not control information that those organisations independently collect for their own purposes.

10. Disclosure of personal information

We do not disclose personal information merely because another organisation would find it useful.

We may disclose personal information to service providers where reasonably necessary to operate, secure or support Clear Weekly.

We may also disclose information:

where you have requested or authorised the disclosure;
where required or authorised by law;
in response to a valid legal requirement;
where reasonably necessary to investigate or prevent unlawful activity or serious security threats; or
where otherwise permitted by applicable privacy law.

Clear Weekly does not sell readers' personal information.

11. Overseas processing and disclosure

Some service providers used to operate Clear Weekly may store or process information outside Australia.

This may include providers of app infrastructure, hosting, analytics, communications, security, push notifications and app-store services.

The countries in which information is processed depend on the service provider and infrastructure being used and may change over time.

Where reasonably practicable and required by applicable privacy law, Clear Weekly will identify the countries in which overseas recipients of personal information are likely to be located.

Where Australian privacy law applies to an overseas disclosure of personal information, we will take the steps required of us under that law.

12. Security and retention

We take reasonable steps appropriate to our circumstances to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure.

Information may be stored using systems operated by Clear Weekly or service providers acting on our behalf.

No internet service, electronic transmission or storage system can be guaranteed to be completely secure.

If we become aware of a data breach, we will assess and respond to it in accordance with applicable legal obligations.

We aim not to retain personal information for longer than reasonably necessary for the purpose for which it was collected, unless we are required or permitted to retain it for longer.

When personal information is no longer reasonably required, we will take reasonable steps, where applicable, to delete, destroy or de-identify it, subject to legal, security, archival and technical requirements.

13. Access, correction and deletion

You may contact Clear Weekly to:

ask whether we hold personal information about you;
request access to personal information we hold about you;
ask us to correct inaccurate or out-of-date personal information; or
request deletion of personal information we hold about you.

We may need to verify your identity before responding to a request.

There may be circumstances in which we are legally permitted or required to retain information or to refuse or limit access.

Where applicable, we will explain a refusal as required by law.

Deletion from active systems may not always result in immediate deletion from secure backups or records that must lawfully be retained.

14. Artificial intelligence

Clear Weekly may use artificial intelligence and other digital tools in its editorial and business processes.

We do not intentionally provide readers' personal information to artificial intelligence services merely for the purpose of generating general news content.

If our use of artificial intelligence materially changes the way we handle personal information, we will update this Privacy Policy and provide any additional notice or obtain consent where required by law.

15. Children

Clear Weekly is a general-audience news service and is not specifically directed at children.

We do not intentionally design the Service to collect unnecessary personal information from children.

If Clear Weekly introduces a feature specifically intended for children or involving the collection of personal information from children, we will consider and implement any additional privacy, consent and safeguarding requirements that apply.

16. Your privacy choices

Depending on the features available, you may be able to:

read general Clear Weekly content without identifying yourself;
decline or disable push notifications;
manage device permissions;
restrict certain cookies through your browser;
unsubscribe from optional communications;
request access to or correction of your personal information; and
request deletion of personal information where applicable.

Some choices may affect the functionality available to you.

17. Privacy questions and complaints

If you have a question or concern about how Clear Weekly has handled your personal information, please contact us using the details below.

Please provide enough information for us to understand and investigate your concern.

We will consider privacy complaints and respond within a reasonable period.

If the Privacy Act 1988 (Cth) applies to your complaint and you are not satisfied with our response, you may have the right to make a complaint to the Office of the Australian Information Commissioner.

Office of the Australian Information Commissioner

18. Changes to this Privacy Policy

We may update this Privacy Policy when Clear Weekly's technology, features, service providers, business practices or legal obligations change.

The current version will be made available through the Service and will display the date on which it was last updated.

If we materially change how we handle personal information, we will take reasonable steps to provide appropriate notice and obtain consent where required by law.
